After U.S. District Court judge Susan Richard said Monday that she would like to see the two sides to return to negotiation prior to her ruling, each have sent letters highlighting their willingness to do so. Judge Richard was presiding at the hearing for the NFL players anti-trust class action lawsuit against the NFL owners.
The lawsuit, which was made possible by the de-certification of the NFLPA, is really a positioning for leverage of sorts. If the judge were to rule in favor of the players and grant an injunction of the NFL lockout, they believe it would give them the positioning they need to get the new CBA closer to their side. If the judge rules the other way, owners believe the claims they’re making would be justified in the eyes of the law and thus, give them the leverage they need to swing the new CBA in their favor.
So now, we have two weeks for them to go back to the table and get this done before the judge rules. Is it likely to yield results? Probably not. What they are actually going back to negotiate is another matter entirely.
The NFL believes that they are going back to negotiate the new CBA, which most feel is about 185 million dollars of allocating off from being complete. The NFLPA believes they are going to negotiate a settlement agreement for the anti-trust lawsuit. Fireworks are sure to ensue. The worst part is this likely just gets us further away from getting a deal done.
